Wardrobe Malfunction…yet Again!!

Today the Supreme Court set aside an earlier ruling by the United States Court of Appeals for the Third Circuit , which I reported in an earlier blog.

The circuit court’s decision had overturned the $550,000 fine against CBS which was imposed by the FCC for the incident during the 38th Super Bowl half time show when Janet Jackson’s bare breast was exposed (aka as the infamous “wardrobe malfunction“).

The high court said the Third Circuit should give “further consideration” to its conclusion last July 21 that the F.C.C. was wrong to fine the network.

If the Third Circuit should once again rule in favor of CBS, and the FCC decides to appeal once again, the case could make its way back to the Supreme Court.
